Terms and Conditions of Service

1. Introduction
These Terms and Conditions (“Terms”) govern your use of DermMedica’s services, including laser treatments performed with the K-laser machine and any other cosmetic procedures supplied by DermMedica. By booking an appointment you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Definitions
“Clinic”, “we”, “us”, and “our” refers to DermMedica.
“Client”, “you”, and “your” refers to the person receiving or booking treatments at the Clinic.

3. Eligibility and Consent
You must be at least 18 years old to receive treatments unless explicitly authorised by law and accompanied by a parent or legal guardian. Prior to any treatment you must complete and sign all required consultation forms, medical history disclosures, and informed consent documents. You agree that all information you provide is accurate and complete.

4. Consultations and Suitability
All treatments are subject to individual assessment. We reserve the right to decline or modify treatments based on medical suitability, skin type, health conditions, medication use, or other factors. You agree that treatment decisions are at the Clinic’s discretion. Results vary and are not guaranteed.

5. Risks, Side Effects, and Aftercare
Cosmetic laser treatments carry inherent risks, including but not limited to redness, swelling, blistering, scarring, pigmentation changes, infection, and other adverse reactions. You acknowledge that these risks have been explained to you and that you accept them. You agree to follow all pre- and post-treatment instructions provided by the Clinic.

6. Booking, Payment, and Prices
Appointments may be booked online, by phone, or in person. All prices are in New Zealand dollars and include GST unless stated otherwise. Payment is due by cash or eftpos only, at the time of service unless otherwise agreed.

7. Cancellations and No-Shows
We require at least 24 hours’ notice for cancellations or reschedules. If you fail to provide sufficient notice or do not attend your appointment, you may be charged a cancellation fee or the full cost of the scheduled treatment.

8. No Refunds/Change of Mind
Except where required by law, all sales of treatments and services are final and non-refundable for change of mind. Refunds may only be provided where legally mandated under the Consumer Guarantees Act or other applicable laws.

9. Liability Limitation
To the fullest extent permitted by law, DermMedica and its officers, employees, contractors, and agents are not liable for any direct, indirect, incidental, special, or consequential loss or damage arising out of or in connection with your use of our services, treatments, or products. This includes, without limitation, loss arising from treatment outcomes, side effects, delays, or your failure to follow aftercare instructions.

Where liability cannot be excluded under New Zealand law, our liability will be limited to the extent permitted by law.

10. ACC and Personal Injury
You acknowledge that any personal injury relating to treatment procedures may be subject to New Zealand’s Accident Compensation Corporation (ACC) scheme. By agreeing to these Terms you understand that you may have no right to sue for personal injury under common law, except as limited by ACC legislation.

11. Privacy and Personal Information
Your personal data will be collected, used, and stored in accordance with applicable privacy laws and our Privacy Policy. By agreeing to these Terms you consent to this handling of your personal information.

12. Intellectual Property
All content on our website and promotional materials remains the intellectual property of DermMedica. You may not copy, reproduce, or use this content without our express written permission.

13. Changes to Terms
We may modify these Terms at any time. Updated terms will be posted on our website and will apply to bookings made after the date of posting.

14. Governing Law
These Terms are governed by and construed in accordance with the laws of New Zealand. Any dispute arising out of or related to these Terms will be subject to the exclusive jurisdiction of the courts of New Zealand.

Acknowledgement Clause
By booking a treatment you confirm that you have read and understood these Terms and Conditions, your informed consent documents, and the associated risks of cosmetic laser procedures.

This structure reflects industry practices in New Zealand cosmetic clinics and typical legal protections, including explicit risk acknowledgment, no refunds for change of mind, cancellation policies, and strong liability limitations. It also recognises the ACC framework limiting personal injury claims under NZ law.
